You must accept without modification these terms and conditions.
By placing an order you agree to be bound by these terms & conditions.
These terms and conditions do not affect your statutory rights as a consumer.
2. Changes To Terms And Conditions
Tower Farms may wish to update or change the terms and conditions from time to time with regard to, changes in the law, or for other good reason. You understand that Tower Farms reserves the right to make these changes and that you are responsible for regularly reviewing these terms and conditions.
3. Cancellation Of Orders
Cancellation of your order can only be made prior to Tower Farms dispatching goods; due to the perishable nature of the goods we regret that cancellation is not possible after dispatch.
4. Delivery
Our postage rates also include packaging. You the customer must be available between the hours 8am and 6 pm to take delivery. We cannot take responsibility for goods left and not signed for.
Delivery throughout the UK is normally next day.
Please ensure your delivery address is correct as Tower Farms cannot be held responsible for non delivery due to wrong addresses.
If there is nobody available to take delivery of the goods Tower Farms cannot be held responsible for the condition of the goods.
We suggest all cheeses are refrigerated upon receipt.
5. Defective Goods
You the customer must inform Tower Farms within 24 hours of delivery if there is any problem with the order; all goods must be returned or made available for inspection before a credit can be issued.
6. VAT
VAT is applicable to some food and drink items. VAT is included in all prices shown. VAT Number 851 198906.
7. Product Substitution
If the goods you have ordered are not available we will email you with a suggested substitution, if this situation should arise you have the right to cancel the order should this not be acceptable. We will not dispatch the order until we have received your confirmation agreeing to this.

9. Data Protection
By purchasing from Tower Farms you the customer agree to Tower Farms collecting data and information for the service of processing your order, monitoring our website performance and advertising purposes. If you do not wish to receive mailings please let us know and we will remove you from our mailing list.
Tower Farms or any of our employees will not forward your data to any other companies. However you will allow Tower Farms to provide data to Government or Regulatory bodies in order to comply with any Laws or Regulations. If any data held is incorrect we will modify data at your request.
10. Fraud
Credit card fraud is a crime, any fraudulent transactions will result in prosecution.
All card information must match those of the issuing bank, submitting false information is fraud and will result in prosecution.
11. Law
The contract between us shall be governed by and interpreted in accordance with English law and the English courts shall have jurisdiction to resolve any disputes between us.
12. Indemnity
You will indemnify, defend and hold us, and our employees, agents and suppliers, harmless immediately on demand, from and against all claims, liability, damages, losses, costs and expenses, including reasonable legal fees, arising out of any breach of these Terms by you or any other liability arising out of your use of this Website, or the use by any other person accessing the Website using your account and/or the information you provided upon registration.
